Last Updated: October 17, 2026

These Terms of Service (“Terms”) govern your access to and use of the website, products, and services offered under the iCreate AI Employees brand. iCreate AI Employees is a service of Wayward Media Inc. (“iCreate AI Employees,” “we,” “us,” or “our”).

By accessing our website or using our services, you agree to these Terms. Additional agreements, proposals, order forms, statements of work, or service terms may apply to paid services and customer deployments. If a separate written agreement conflicts with these Terms, the separate written agreement will control to the extent of that conflict.

1. Our Services

iCreate AI Employees provides AI-powered business communication, automation, and workflow solutions. Services may include AI voice receptionists, lead engagement, qualification workflows, appointment scheduling, follow-up systems, CRM integrations, and related automation services.

Specific functionality depends on the services purchased, configuration selected, third-party platforms used, and customer requirements.

We may modify, improve, replace, or discontinue features as our services and underlying technologies evolve.

2. Artificial Intelligence

Our services use artificial intelligence and automated technologies.

AI systems can misunderstand information, produce inaccurate or incomplete responses, experience technical limitations, or behave differently than expected. AI-generated information should not automatically be treated as verified professional, legal, medical, financial, insurance, or other regulated advice.

Customers are responsible for determining whether AI-generated information or automated actions are appropriate for their business and for establishing appropriate human review and escalation procedures.

We do not guarantee that an AI Employee will perform every task without error or completely replace human personnel.

3. Customer Responsibilities

Customers are responsible for the lawful and appropriate deployment of services configured for their organization.

This includes responsibility for:

  • Information, instructions, scripts, prompts, policies, and business rules supplied to the AI system
  • Accuracy of information supplied about the customer’s business
  • Determining which tasks may appropriately be automated
  • Establishing appropriate human oversight
  • Obtaining required permissions and consents
  • Providing legally required notices and disclosures
  • Complying with laws and regulations applicable to the customer’s business, industry, communications, and customers
  • Maintaining appropriate security for accounts, credentials, and connected systems

Customers must not instruct or use our services to engage in unlawful, fraudulent, deceptive, abusive, discriminatory, or otherwise prohibited activity.

4. Telephone, SMS, and Electronic Communications

AI-powered telephone, SMS, email, and similar communication services may be subject to federal, state, and local laws and regulations.

Customers using our services for outbound calls, text messages, prerecorded or artificial voice communications, marketing, solicitation, or similar activities are responsible for determining and satisfying applicable consent, disclosure, identification, opt-out, do-not-call, calling-time, recordkeeping, and other legal requirements.

Our provision of communication technology does not constitute legal advice or a determination that a particular communication campaign or use is legally permissible.

5. Call Recording and Transcription

Certain service configurations may support call recording, transcription, summarization, or analysis.

Laws governing recording and monitoring communications vary by jurisdiction.

Customers are responsible for determining whether recording or transcription is appropriate for their use and for implementing required notices, disclosures, and consent procedures.

6. Regulated and Professional Activities

Our AI systems are designed to support business communications and workflows. They are not licensed professionals and should not be used as substitutes for licensed or regulated professionals where professional judgment, authorization, licensing, or human involvement is legally required.

Customers operating in regulated industries are responsible for configuring and supervising their AI systems consistently with the laws, regulations, professional standards, licensing requirements, and contractual obligations applicable to their businesses.

7. Third-Party Services

Our services may depend on or integrate with third-party platforms and providers, including telecommunications, artificial intelligence, voice processing, hosting, CRM, scheduling, email, SMS, analytics, and other technology services.

Third-party services may be governed by their own terms, privacy policies, acceptable-use policies, pricing, limitations, and availability.

We are not responsible for interruptions, changes, restrictions, failures, or actions caused by third-party services that are outside our reasonable control.

8. Service Availability

We work to provide reliable services, but we do not guarantee uninterrupted or error-free operation.

Services may occasionally be unavailable because of maintenance, telecommunications failures, internet outages, third-party provider issues, software problems, security events, or circumstances beyond our reasonable control.

Customers should maintain appropriate alternative procedures for business-critical communications and workflows.

9. Fees, Billing, and Paid Services

Pricing, setup fees, recurring charges, usage charges, included services, overage charges, payment schedules, cancellation provisions, and other commercial terms for paid services will be disclosed in the applicable proposal, order form, subscription, invoice, or other service agreement.

Certain services may generate usage-based charges, including telecommunications, messaging, artificial intelligence processing, or other metered services.

Customers are responsible for charges they authorize under the applicable service arrangement.

We do not guarantee business revenue, cost savings, lead volume, appointment volume, sales performance, return on investment, or other financial results from using our services.

10. Intellectual Property

The iCreate AI Employees name, branding, website content, service designs, documentation, workflows, and other materials created by or for us are owned by Wayward Media Inc. or used with appropriate permission and are protected by applicable intellectual property laws.

Customers retain ownership of their own business information, trademarks, content, and materials that they provide to us, subject to any permissions reasonably necessary for us and our service providers to deliver the requested services.

Specific ownership or licensing terms for custom-developed materials may be addressed in a separate written agreement.

11. Acceptable Use

You may not use our website or services to:

  • Violate applicable law or regulation
  • Commit fraud or intentionally deceive others
  • Harass, threaten, or abuse individuals
  • Impersonate another person or organization without authorization
  • Send communications without legally required consent
  • Circumvent opt-out or do-not-call requests
  • Introduce malware or attempt unauthorized access to systems
  • Interfere with the security or operation of our services
  • Use the services in a manner that infringes the rights of others

We may restrict or suspend access to services when reasonably necessary to address suspected unlawful activity, security threats, abuse, nonpayment, or material violations of applicable agreements.

12. Confidentiality and Data

Our handling of personal information is described in our Privacy Policy.

Customers should not provide unnecessary sensitive information to AI systems or connected services.

Additional confidentiality, security, data-processing, or industry-specific requirements may be addressed in separate written agreements where appropriate.

13. No Professional Advice

Information provided through our website, demonstrations, AI systems, or general communications is for business and informational purposes unless a separate written agreement expressly provides otherwise.

Nothing provided by iCreate AI Employees should be interpreted as legal, tax, accounting, medical, financial, insurance, or other licensed professional advice.

Customers should consult appropriately qualified professionals regarding requirements applicable to their businesses.

14. Warranties and Disclaimers

We aim to provide useful and reliable services, but AI and automated systems have inherent limitations.

Except as expressly stated in a separate written agreement, services are provided on an “as available” basis to the extent permitted by applicable law.

We do not warrant that services will be uninterrupted, completely secure, error-free, or suitable for every particular business purpose, or that AI-generated responses will always be accurate or complete.

Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

15. Limitation of Liability

To the maximum extent permitted by applicable law, Wayward Media Inc. and iCreate AI Employees will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to use of the website or services.

Any limitations applicable to a paid customer relationship may also be specified in the applicable service agreement.

Nothing in these Terms limits liability where such limitation is prohibited by law.

16. Indemnification

To the extent permitted by applicable law, customers agree to be responsible for claims, losses, or liabilities arising from their unlawful use of the services, content or instructions they provide, violation of applicable law, or violation of the rights of another person or organization.

Any additional indemnification obligations applicable to paid services may be established in a separate written agreement.

17. Suspension or Termination

We may suspend or terminate access to services when reasonably necessary because of nonpayment, material violation of applicable agreements, unlawful activity, security concerns, abuse of the services, or requirements imposed by third-party providers or law.

Customer cancellation and termination rights for paid services will be governed by the applicable service agreement or subscription terms.

18. Changes to These Terms

We may update these Terms as our services, technology, or legal requirements change.

The “Last Updated” date will identify the most recent revision.

Material changes affecting an existing paid customer relationship may also be addressed according to the applicable customer agreement and applicable law.

19. Governing Law

Unless a separate written agreement provides otherwise, these Terms are governed by the laws applicable to Wayward Media Inc., without regard to conflict-of-law principles.

Nothing in this section eliminates rights or protections that cannot lawfully be waived.
